Regardless of any statements to the contrary in this document, neither the Company nor its affiliates or related parties will be liable to you or any third party for any indirect, incidental, special, or consequential damages, or for any loss of revenue or profits that arise in connection with these Terms or the Services.
To the maximum extent permitted by law, you agree to waive, release, discharge, and hold harmless the Company, its affiliated and subsidiary companies, its parent companies, and each of their directors, officers, employees, and agents from any claims, losses, damages, liabilities, expenses, and causes of action arising out of the Services.
You agree to indemnify and defend the Company, its parent companies, subsidiaries, and affiliates, holding them harmless from any claims, lawsuits, or losses arising from your access to or use of the Services, violation of these Terms, or any infringement by a third party using your account. If required by law enforcement or government agencies, the Company may disclose your data in criminal investigations, and you agree to this practice.
The Company firmly reserves the right to add, modify, or discontinue the Services (or any part of them) at any time, whether temporarily or permanently, and with or without cause. The Company will not be liable for any adjustments, suspensions, or discontinuations of the Services.
The Terms outlined herein shall be governed by and interpreted in accordance with the laws of India. Exclusive jurisdiction over all matters arising from these Terms or the use of the Services shall rest with the courts located in Bangaluru, subject to any other provisions specified in this Clause. Any controversies, conflicts, disputes, or differences arising out of these Terms will be resolved through arbitration in Bangaluru, in accordance with the Arbitration and Conciliation Act, 1996, which is hereby incorporated by reference into this Clause. The arbitration tribunal shall consist of a single arbitrator appointed by the Company. The proceedings will be conducted in English. All parties involved in the arbitration shall uphold confidentiality and shall not disclose any related information to external parties, except on a need-to-know basis or to legal advisors, unless disclosure is mandated by law. The arbitrator’s decision shall be final and binding on all parties involved. Each party shall be responsible for its own costs incurred in relation to any disputes arising from this arbitration process.
